Words matter. Laws matter. The Constitution matters.
But not to democrats.
Article One in the impeachment charges against former President Trump from the House of Representatives is titled “Incitement of Insurrection.”
However, not one person (including Trump) involved in the events at the Capitol on January 6th has been convicted – or even charged – with insurrection.
However, somehow Trump is on trial for inciting an insurrection.
What insurrection?
The genius democrats have charged Trump for inciting a crime that no one has been charged with.
Additionally, the people who have been arrested because of charges that WERE made by the FBI have not been proven and none of the 200+ defendants have been convicted of anything, not even stealing an envelope from Nancy Pelosi’s desk.
Talk about bringing the cart before the horse.
Is this how the democrats operate? They put a private citizen on trial for being involved in a conspiracy and facilitation of a crime that no one has been charged with? Yes, that’s how they operate.
So why is everyone talking about insurrection?
Because the democrats and their leftist friends like the word.
The democrats obviously put out a memo to call what happened an insurrection whether it was or not. But legally speaking, it never happened.
No charges for it. No arrests. No convictions.
Leftists don’t care much about reality or following the law because the impeachment is all a big show to take down the evil Trump supporters who they lump together to all be domestic terrorists.
The leftist Trump haters won’t question the language that the democrats or the media uses. They’ll just nod and re-Tweet whatever is in front of them.
But there is a list of the actual charges against the people who were at the Capitol on January 6th. They were charged and arrested for many of the same things that have been done the past year by Black Lives and Antifa. Except, of course, BLM and Antifa pretty much got a free pass for all of their violence and crimes.
The only difference in their crimes is that the January 6th folks were charged with doing things at “the Capitol” whereas the AntifaBLM terrorists only went after police stations, federal buildings, and police cars.
Charges against the defendants at the Capitol on January 6th include entering and remaining in a restricted building; disorderly and disruptive conduct in a restricted building; violent entry and disorderly conduct; parading, demonstrating, or picketing in a Capitol building; civil disorder; assaulting, resisting or impeding certain officers; destruction of government property; violent entry; willfully and knowingly utter loud, threatening or abusive language (didn’t know that was a thing); possession of unregistered firearm (destructive device) and carrying pistol without a license; and other charges.
Nope, not one word about insurrection.
The FBI has not charged anyone with insurrection.

Obviously, that is because the government doesn’t feel that what the defendants did has met the legal definition of the crime of insurrection. Most of the people arrested at the Capitol didn’t have weapons and I doubt any of them had any real plans of taking over the government – except maybe the dude in Nancy Pelosi’s office with his feet on her desk.
And as far as Trump is concerned, Senator Mike Lee recently pointed out in an interview on Newsmax that the Supreme Court decision in 1969 concerning insurrection requires intention.
In the case Brandenburg vs. Ohio, the Court held that the government can’t punish inflammatory speech unless the speech is “directed to inciting or producing imminent lawless action and likely to incite or produce such action.”
The helter-skelter strategy of the democrats to impeach Trump started out by them saying that he incited an insurrection at his rally. But, oops, the assault on the Capitol was planned before that. Reports showed that plans were made and things were done before Trump even started his January 6th speech.
Then the democrats said that Trump incited people for months by railing against the democrats stealing the election. But the word imminent doesn’t mean actions that took place two months later.
Trump was using a metaphor in his Tweets, his interviews, his rallies and at his speech on January 6th when he called for his supporters to fight against the stolen election.
He used the word “fight” just like all of the democrats did before him in the four years they encouraged their supporters to go after Trump, his Cabinet members and supporters.
And what’s even more ridiculous is the fact that 46 of the Senators are attorneys so you would think that they would know better and might actually follow the laws or adhere to the Constitution they swore an oath to support and defend.
But being a lawyer only means that you have experience in getting AROUND the law and talking a good game.
There’s a reason people like the joke “What Do You Call 100 Lawyers at the Bottom of the Ocean?”
The answer is “A good start.”
