Less than two months after the California Supreme Court overturned Scott Peterson’s death penalty for the murders of his pregnant wife Laci and their unborn child, the court has ordered his conviction to be reexamined, which means it could possibly end up being overturned.
Daily Mail reported that the highest court in California ordered the San Mateo County Superior Court, where Peterson was initially tried for the 2002 murders in 2004, to consider whether he should be given a new trial. This came after Peterson’s lawyers filed a petition that listed out several reasons why they feel the conviction should be overturned.
The California Supreme Court ended up ruling that Peterson’s conviction should be reexamined so as to determine if he should get a new trial based on a juror failing to disclose that she had been involved in previous legal proceedings. This juror, who has been identified as Richelle Nice, did not tell the court that she had filed a lawsuit in 2000 attempting to obtain a restraining order after her boyfriend’s ex-girlfriend harassed her while she was pregnant. Nice had said in the lawsuit that she feared for the life of her unborn child.
Peterson’s lawyers claimed that Nice responded with a “no” when she was asked as a potential juror she had ever been a victim of crime or involved in a lawsuit. They allege that she purposely lied to the judge just so that she could become a juror on a high profile case that was making headlines nationally. Nice, who was one of the jurors to jointly publish a book about the case, has denied claims that she lied to get on the jury.
Laci was eight months pregnant with her and Peterson’s unborn son Connor when she went missing on Christmas Eve in 2002. It took five months for her body to be found after police say that Peterson killed her and dumped her remains in the San Francisco Bay. He was sentenced to death in 2005 and had been on death row for fifteen years before his death penalty was overturned by the California Supreme Court over the summer.
