Frustrated and angry Democrats, seeing their loss on Barrett and sensing a lack of Biden momentum, are spewing forth venom at a record pace. Their big idea, an old idea: pack the courts until they have a majority. So, there may be an extra 12 justices under a Biden administration. I mean, why not, according to their logic?
“The Republican majority is lighting its credibility on fire … The next time the American people give Democrats a majority in this chamber, you will have forfeited the right to tell us how to run that majority,” Senate Minority Leader Chuck Schumer of New York Monday.
“The President’s Supreme Court manipulation threatens the very values and rights that define and distinguish our nation: a woman’s constitutional right to make her own medical decisions, the rights of LGBTQ Americans, the right of workers to organize and collectively bargain for fair wages, the future of our planet and environmental protections, voting rights and the right of every American to have a voice in our democracy,” Nancy Pelosi wrote in a statement.
“Will Democrats go to new, extraordinary lengths to maximize their power given the extraordinary lengths Republicans have gone to maximize their power? This is not a conversation that is ripe enough yet, but what do Republicans expect?” said Democrat Senator Chris Murphy of Connecticut. “Do we just unilaterally stand down and not choose to use the same tools that Republicans did in the majority? … I think there are now new rules in the Senate, and I think Republicans have set them,” he added.
Senator Sheldon Whitehouse, Democrat of Rhode Island called the confirmation a “sad day for the Senate and for the Court. My Republican colleagues put the rule of ‘because we can’ over the traditions and precedents of the Senate, the principles we hold dear as an institution, and the integrity of the federal judiciary.”
“This court is illegitimate, and must not be allowed to wreak misery on millions of Americans in service of a far-right minority and their corporate backers,” said 21 Democrat elected New York state officials. It was said in a letter reported by The Intercept’s Ryan Grim. “Congressional Democrats must end the filibuster and pass legislation to expand the court. Should he win, Joe Biden must sign it into law.”
NEW: More than 20 New York progressive elected officials are calling on Schumer to commit to expanding the Supreme Court.

The Squad went with the flood of rhetorical sewage. AOC of New York said, “Expand the court. Republicans do this because they don’t believe Dems have the stones to play hardball like they do. And for a long time they’ve been correct. But do not let them bully the public into thinking their bulldozing is normal but a response isn’t. There is a legal process for expansion.”
Her House pal Rashida Tlaib of Michigan said, “We must expand the Court if we’re serious about the transformational change the people are crying out for.”
And Ilhan Omar of Minnesota said, “Remember that Republicans have lost 6 of the last 7 popular votes, but have appointed 6 of the last 9 justices. By expanding the court we fix this broken system and have the court better represent the values of the American people.”
