Democratic Michigan Governor loves her Executive Orders that the COVID-19 pandemic has allowed her to issue. So far she’s up to order #169. And she’s constantly rescinding one and re-writing another so you have to read the entire new order and guess what the heck she changed.
I gave up caring about her orders around executive order #129. I live my life. If I get arrested for not wearing a mask in a purple bathroom on a Tuesday, so be it. As Trump says, “it is what it is.”
The only reason I have to keep up with some of her tyranny is for this writing gig. Otherwise, I’d have nothing to do with her.
Whitmer loves going after Michigan business owners to make examples of them when they don’t comply with her orders, like Karl Manke, America’s Barber in Owosso, who, thanks to his great attorney, David Kallman, has kicked Whitmer butt in court every time and is still open.
This time Whitmer is going after Friske Orchard [1] in Ellsworth, a small town in northern lower Michigan, north of Charlevoix.
Frisky Orchards Farm Market has a bakery, cafe, fruit stand, gift shop plus an outdoor entertainment area and has served the community for three generations.
What is their crime?
They aren’t making their staff wear masks. Or their customers.
But of course, some freaked out liberals turned them in and now Friske have been served papers.
According to Randy Bishop [2] in his podcast, Friske lets employees and customers make personal decisions about their own health – everyone is welcome, mask or no mask. The owner of Friske had talked with his employees and they didn’t want to work with masks on all day long.
The owners of Friske Orchards filed suit against Whitmer on August 5th, as well as the local health department and two state agencies to challenge the governor’s mask mandate.
Their attorney? David Kallman.
In an article from the Detroit News, Kallman said, “Friske has been serving the community for three generations, and now faces the forced closure of its business for refusing to submit to unlawful and illegal executive orders. This case is not about masks; it is about abuse of power.”
The lawsuit argues that the orders are invalid and violate the commerce clause, separation of powers and due process rights. The lawsuit also asks for a preliminary injunction so that the business can be open until the judge rules on the case.
As usual, an avalanche of government abuses against Friske came at them.
The Michigan Occupational Safety and Health Administration, on July 20th and 21st, threatened Friske for their failure to make employees and customers wear a mask.
Then on August 1st, Friske was served with a public health order from the Health Dept. of Northwest Michigan saying that the business was an “imminent danger to the health and lives of the public” because the mask mandate wasn’t being enforced. They were threatened with legal action and suspension of their business license – backed by the Michigan Dept. of Agriculture and Rural Development, of course. Big Gretch has all of her ducks in a row.
If all the penalties were levied against Friske from MIOSHA, MDARD and the Health Dept., they could be paying up to $70,000 according to the Detroit News.
The press release about the lawsuit states, “The Court of Claims has already ruled that the Governor cannot weaponize her state agencies to prosecute a business for violating her executive orders yet the governor continues with her administrative actions against Friske in direct contempt of this prior court order.”
So instead of just quietly going to a different business like a normal person…
Instead of just going by the old adage of “live and let live…”
It looks like a gaggle of local women (at least one of which who went to the store) got irritated by the way the store was being ran and started calling the local health department and other agencies.
Liberals are the least tolerant people on the planet. It’s their way or the highway.
Who was it a while ago that was turning in their neighbors to the government to report “suspicious” behavior?
